1. Introduction

Welcome to Octavia Labs, the pioneering creators of Octavia, your advanced web3 Assistant. The following Terms of Use ("Terms") are designed to govern your access to and use of Octavia and related products, services and tokens ("Product"), a service meticulously crafted and provided by Octavia Labs ("we", "us", or "our"). By accessing or utilizing Octavia, you are expressing your agreement to adhere to these Terms.

It is important you read and understand these terms, as they govern your usage of the services, and your potential rights to use outputs generated by Octavia. If you find yourself in disagreement with these Terms, we respectfully request that you refrain from using Octavia.

2. Acceptance of Terms

By accessing or using Octavia, the VIA token, or any other services you affirm that you possess the legal capacity to enter into a binding contract with Octavia Labs, that you have thoroughly read, understood, and accepted these Terms, and that you agree to comply with them in their entirety. Your access to and use of Octavia is also subject to our Privacy Policy, the terms of which are readily available on our website and are incorporated into these Terms by reference for your convenience and understanding.

3. Prohibited Conduct

As a valued user of Octavia, you may not use our services, token or Octavia to:

a. Engage in any unlawful activities, including but not limited to fraud, money laundering, illegal gambling operations, rugpulls/scams, terrorist activities, hacking, or any other illegal activities or in violation of any local, state, national, or international laws.
b. Infringe upon the rights of others, including but not limited to the privacy rights, intellectual property rights, and contractual rights of others, or encourage others to do the same.
c. Distribute, Generate or promote any harmful or inappropriate content, including but not limited to pornography, hate speech, or non-fantasy violent content.
d. Harass, threaten, defame or otherwise abuse any person or entity.
e. Interfere with the operation of Octavia or the servers or networks used to provide Octavia, including by reverse engineering or attempting to gain unauthorized access to Octavia or related systems or networks.
f. Engage in any conduct that inhibits anyone's use or enjoyment of Octavia, or which we determine may harm Octavia Labs or users of Octavia.
g. Use Octavia in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying Octavia or that could damage, disable, overburden or impair the functioning of Octavia in any manner.
h. Attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of Octavia that you are not authorized to access.
i. Falsely imply any sponsorship or association with Octavia Labs or claim that we have endorsed you or any products or services without our express written consent.
j. Generate or attempt to generate illegal content with image/sound/video/text generation features.
k. Attempt to gain unauthorized access to Octavia or to other users' accounts.
l. Use Octavia for any commercial purposes without our prior written consent.

4. Sanctions

You agree not to violate US Sanctions in you use of our services and tokens. It is your responsibility to comply with all applicable laws and regulations.

5. Intellectual Property

a. Octavia, inclusive of its original content, features, and functionality, are and will remain the exclusive property of Octavia Labs and its licensors. Octavia is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Octavia Labs.
b. When generating text content with Octavia, you receive an unlimited world-wide royalty free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute the content created. This license is non-exclusive, meaning you do not have exclusive rights to the content generated and Octavia Labs reserves the right to use the same content for other purposes.
c. When generating image or video content with Octavia, you, the user, gain full ownership of the images created. By using Octavia, you grant Octavia Labs a worldwide, non-exclusive, perpetual and irrevocable royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such images in any and all media or distribution methods (now known or later developed) for the purposes of promoting Octavia Labs and operating our services. This license does not affect your ownership rights and is solely for the purposes stated.
d. When using Octavia's Voice and generating Audio Content, you receive an unlimited world-wide royalty free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute the content created. However, you must not use the content in any way which may bring disrepute to Octavia, or Octavia Labs.
e. The above ownership and licenses only are granted when the content is generated in line with the Terms of Use, and any modified content must also not violate the terms of use, be obscene, or risk otherwise bringing our services, Octavia, or Octavia Labs into disrepute.

6. Email Notification Service

a. Consent to Receive Email Notifications By accepting these Terms and Conditions and opting into the email notification service, you agree to receive email communications from us regarding critical alerts about moderation thresholds being reached on your platforms (such as Discord and Telegram channels that you manage). These notifications are intended to inform you of significant moderation activities that may require your attention or immediate action.
b. Nature of Email Alerts Email alerts will provide you with information regarding specific instances when preset moderation thresholds are exceeded. Details provided in these alerts may include the time of the incident, the nature of the content flagged, and the action required or taken.
c. Managing Preferences At any point, you may choose to opt out of receiving these email alerts by adjusting your notification settings in your user account or by clicking the "unsubscribe" link provided in every email notification. Opting out will cease all future email notifications unless you re-subscribe at a later date.
d. Privacy and Data Use** The information collected for the purpose of sending email alerts will be handled in accordance with our Privacy Policy, which provides detailed information on how your data is collected, used, and protected. We commit to maintaining the confidentiality and security of your data.
e. Compliance with Laws Our email notification service is compliant with applicable email communication laws and regulations. We ensure all communications are sent in a lawful manner, and you are afforded all rights under relevant laws to manage your receipt of such communications.

7. Monitoring and Enforcement

While we are not obligated to monitor access to or use of Octavia, we reserve the right to do so for the purpose of operating Octavia, ensuring compliance with these Terms, and complying with applicable law or other legal requirements. We reserve the right to remove or disable access to any content, at any time and without notice, if we believe it to be in violation of these Terms.

Additionally, We reserve the right to take any action we deem necessary to enforce this Policy, including but not limited to suspending or terminating your access to Octavia, removing any prohibited content, or taking legal action.

For the avoidance of doubt, these terms apply to all services, products and tokens offered by Octavia Labs, including access to this website.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page. Changes to these Terms are effective when they are posted on this page.
